Citizens' Comment


Citizens are offered an opportunity to address the Board at its public meetings with comments and concerns related to the District’s business and public policy.  On March 16, 2020, normal procedures for addressing the Board were amended.  In an attempt to mitigate the spread of COVID-19 (the Coronavirus), Texas Governor Greg Abbott issued orders suspending certain provisions of the Texas Open Meetings Act with the intention of reducing face-to-face contact and avoiding meetings that bring people into large group settings.  At the same time, the Governor required that all governmental entities maintain transparency by offering alternative methods for the public to communicate with their public officials.    

To this end, Governor Abbott relaxed laws related to the conduct of public business by governmental entities, such as our School District, by allowing for meetings to be conducted by telephonic or videoconferences.  As a local governmental entity of the state, SAISD has taken measures to provide access to Board meetings by the public without requiring the physical presence of Board members, staff, or the public at those meetings. Consequently, and until further notice, all meetings of the Board of Trustees of the San Antonio Independent School District will be held by videoconference.  

Citizens may view and listen to the open session portion of the meeting by a free videoconference link that will be posted on the District’s website approximately one hour prior to the start of the meeting.  Citizens who wish to address the Board during the Citizens’ Presentation section of the meeting may do so, but must first sign up by emailing no later than 24 hours prior to the start of the meeting.  Please include your name, address, phone number, and a written statement of your comments, and specify the item on the posted open session agenda to which you will address your comments.  If you are not addressing an item on the posted agenda, please specify the subject of your comments, along with your name, address, phone number, and your written statement.  All statements addressing items on the agenda will be publicly read within the time allotted for each statement.  If time permits, all other statements may also be read.  All submitted written statements, however, will be forwarded to the Board members for their review.  

Pursuant to Board Policy BED (LOCAL), an individual’s comments to the Board shall not exceed three minutes per meeting.  When necessary for effective meeting management to accommodate large numbers of individuals wishing to address the Board, the presiding officer may make adjustments to public comment procedures, including adjusting when public comment will occur during the meeting, reordering agenda items, deferring public comment on non-agenda items, continuing agenda items to a later meeting, providing expanded opportunity for public comment, or establishing an overall time limit for public comment and adjusting the time allotted to each speaker.  However, no individual signed up to speak on an item on the posted agenda shall be given less than one minute to make comments. 

Live streaming, a copy of the agenda, and a subsequent recording of the meeting may be found on the District’s website.  

At all meetings of the Board of Trustees other than Regular Board Meetings, only those statements submitted by citizens that address items on the posted open session agenda will be publicly read.  All other statements will be forwarded to the Board members for their review.  

Public Comments:
Citizens requesting to have their submitted statements read at a Board meeting are asked to address concerns related to District matters and/or public policy.  The Board requests that presentations not include statements that may be considered defamatory.  The Board further requests that citizens’ statements not mention student names, unless the student is a child of the citizen.  Citizens should not negatively reference District employees.  All citizens are advised to follow the proper channels set out in District policy to seek an administrative resolution to any concerns or complaints before bringing such matters to the Board.  It is the intent of the Board in establishing these procedures to uphold a citizen’s right to free speech and to petition the Board for redress of grievances.  

Statements that do not follow the rules established in this limited public forum will not be read at a public meeting, but will, instead, be sent to all Trustees for their review.

Delegations (numerous individuals signed up to speak on same topic): 
The presiding officer, by virtue of authority granted by law and Board policy, may consolidate statements addressing matters that are similar in topic and that are not listed as items on the posted agenda.  

Complaints against District employees: 
The presiding officer shall determine whether a written statement submitted by a citizen is a complaint against a District employee.  If so, the presiding officer will direct the citizen to the appropriate Board policy to seek resolution before bringing the matter to the Board at a public meeting.  [See Board Policy BED (LOCAL)].  

Closed Session: 
If, during the course of the meeting covered by this Notice, the Board of Trustees should determine that a closed or executive meeting or session of the Board of Trustees is required, then such closed or executive meeting or session, as authorized by the Texas Open Meetings Act, Tex. Gov’t Code §§ 551.001, et seq., will be held by the School Board at the date, hour, and place given in this Notice, as the School Board may conveniently meet in such closed or executive meeting or session concerning any and all purposes permitted by the Act, including, but not limited to, the following sections and purposes:

551.071 Consultation with Attorney.
551.072 Deliberation Regarding Real Property. 
551.073 Deliberation Regarding Prospective Gifts. 
551.074 Personnel Matters.
551.076 Deliberation Regarding Security Devices. 

Should any final action, final decision, or final vote be required in the opinion of the School Board with regard to any matter considered in such closed or executive meeting or session, then the final action, final decision, or final vote shall be either: 

(a) In the open meeting covered by the Notice upon the reconvening of the public meeting; or 
(b) At a subsequent public meeting of the School Board upon notice thereof, as the School Board shall determine.
